A Personal Injury Lawyer Can Provide Peace of Mind

Personal Injury law encompasses a broad spectrum of situations and occurrences in which a person is injured due to the wrongful act of another.

A personal injury lawyer at Vigil & Alford, PLLC has substantial personal injury and litigation experience.  Collectively, Jimmy Vigil and Kimberly Alford have obtained millions of dollars in judgments and negotiated settlements.

Motor Vehicle Accidents

In Colorado, liability for most motor vehicle accidents is based on the common law theory of negligence under tort liability.  In a negligence claim, the person responsible for the accident had a duty to act in a reasonable manner, and when that person breached that duty, they caused injury to the victim. In such a situation, the wrongful party is responsible for the injuries, damages, and losses caused by the negligent act.

The Denver and Colorado Springs metropolitan areas are notorious for catastrophic car accidents. Both are growing in commerce and population. Colorado has well over fifty colleges and universities, and is home to several military installations –five in Colorado Springs alone.  How do these factors affect automobile accidents in Colorado?  Well, colleges and military installations bring people from all over the world together. This is great for commerce, but not for driving because it puts people with inconsistent driving experience, habits, and behavior together on the same road. Combine all of this with Colorado’s unique weather, road conditions, and terrain, and you create the ideal environment for automobile accidents.

It is very important to know what to do if you are in an accident.  If you are injured, call 911 immediately.  Vigil & Alford also advise you to contact the police so that the accident scene may be investigated.  We further suggest that you do not give a recorded statement until after you consult with an attorney.   Remember, often insurance companies will try to settle the matter directly with you for less than its value shortly after an accident, and before you realize the full extent of your injuries.  Therefore, contact an attorney as soon as possible.

Premises Liability:

Other types of personal injury claims are premises or property based. For example, someone injured on another’s property because of a dangerous condition on the property may have a claim under the Colorado Premises Liability Act.

In Colorado, claims for injuries that occur because of a dangerous condition on the property of another are governed by the Colorado Premises Liability Act (Act).  Under the Act, landowners are held responsible for dangerous conditions on their property, and the standard for liability and duties imposed upon the landowner, or person in possession of the property, are based upon the status of the person injured (Invitee, Licensee, or Trespasser).

A premises liability case should be handled by an experienced attorney, familiar with the Colorado Premises Liability Act.  The attorneys of Vigil & Alford, PLLC have substantial experience and have successfully negotiated and resolved numerous Premises Liability claims.

Product Liability:

Another common type of personal injury claim is based upon injuries or death caused by dangerous products that have been placed in the marketplace.   These products can range from bicycles to prescription medication.  This type of law is called Product Liability and the standards of a product liability case range from the negligence to strict liability.  These cases are often very complex, and require expert witnesses including engineers and doctors to determine liability.  Therefore it is very important to contact an attorney at Vigil & Alford, PLLC immediately if you feel that you have a product liability claim.

Wrongful Death Claims:

Sometimes the wrongful acts of others may result in death. A valid claim may be made on behalf of the survivor’s spouse and/or heirs under the Colorado Wrongful Death Act.  Pursuant to C.R.S. Section 13-21-202:

When the death of a person is caused by the wrongful act, neglect, or default of another, and the act, neglect, or default is such as would, if death had not ensued, have entitled the party injured to maintain an action and recover damages in respect thereof, then, and in every such case, the person who or the corporation which would have been liable, if death had not ensued, shall be liable in an action for damages notwithstanding the death of the party injured.

With any type of personal injury claim there are specific deadlines that must be met otherwise the claim will be forever barred.  It is important to contact the experienced attorneys of Vigil & Alford, PLLC to properly handle your personal injury claim.
